LEGISLATIVE COUNSEL'S DIGEST SB 558, T. Campbell. Child abuse: false allegation. Under existing law, if a court determines that an accusation of child abuse or neglect made during a child custody proceeding is false and the person making the accusation knew it to be false at the time, the court may impose reasonable money sanctions and attorney's fees against the accuser. This bill would require a motion by a parent for reconsideration of an existing child custody order to be granted if that motion is based on the fact that the other parent was convicted of a crime in connection with falsely accusing the moving parent of child abuse. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 3022.5 is added to the Family Code, to read: 3022.5. A motion by a parent for reconsideration of an existing child custody order shall be granted if the motion is based on the fact that the other parent was convicted of a crime in connection with falsely accusing the moving parent of child abuse.
